Official Caution issued to Remondis Australia Pty Ltd

(SSD-10447) Port Stephens LGA

On 1 March 2024, NSW Planning issued an Official Caution to Remondis Australia Pty Ltd (Remondis) for carrying out development not in accordance with their consent, by storing equipment (skip bins and other equipment) outside the approved project boundary at their Port Stephens facility between 22 March 2022 and 30 October 2023. Remondis cooperated with the department’s investigation and has since removed all of the skip bins and other equipment from outside the project boundary. 

Development Control Order issued to FRV Services Australia Pty Ltd

(SSD-9874) Greater Hume Shire LGA

On 7 March 2024, NSW Planning issued a Development Control Order (DCO) to FRV Services Australia Pty Ltd to remove an earthen levee bank constructed at the Walla Walla Solar Farm without approval. FRV cooperated with the department’s investigation and has since removed the levee and complied with the Terms of the DCO.

Penalty Notice issued to Richard Crookes Constructions Pty Ltd

(SSD-9691) Bayside LGA

On 12 March 2024, NSW Planning issued a $15,000 Penalty Notice to Richard Crookes Constructions Pty Ltd for not carrying out development in accordance with the consent for the Orica Southlands Warehouse Estate development, by removing 16 trees that were identified for retention. The company cooperated with the department’s investigation and has since been directed to replant 24 trees to compensate for those removed.

Penalty Notice issued to Williamtown Sand Syndicate Pty Limited

(SSD- 6125) Port Stephens LGA

On 22 March 2024, NSW Planning issued a $15,000 Penalty Notice to Williamtown Sand Syndicate Pty Limited for failing to update the Maximum Extraction Depth Report for the Cabbage Tree Road Sand Quarry at the timing required by the conditions of consent.  The company is currently preparing the report which the department expects to be submitted imminently.
